Das Ziel besteht darin, die Gesellschaft entweder vollst\u00e4ndig zu sanieren oder mit den Gl\u00e4ubigern einen Nachlassvertrag abzuschliessen. Die Nachlassstundung wird durch ein entsprechendes Gesuch beim zust\u00e4ndigen Nachlassgericht eingeleitet.<\/p>\n<p>Im Gesuch ist die finanzielle Situation der Gesellschaft darzulegen, wobei das Gesuch gem\u00e4ss Art. 293 ff. SchKG zwingend folgende Beilagen zu enthalten hat:<\/p>\n<ul>\n<li>eine aktuelle Bilanz der Gesellschaft<\/li>\n<li>eine Erfolgsrechnung<\/li>\n<li>eine Liquidit\u00e4tsplanung oder entsprechende Unterlagen, aus denen die derzeitige und k\u00fcnftige Verm\u00f6gens-, Ertrags- oder Einkommenslage des Schuldners ersichtlich ist, sowie<\/li>\n<li>ein provisorischer Sanierungsplan<\/li>\n<\/ul>\n<p>Die Gesuchstellerin kann das Gericht um provisorische Nachlassstundung f\u00fcr maximal vier Monate ersuchen. Auf Antrag kann die provisorische Nachlassstundung in begr\u00fcndeten F\u00e4llen um weitere vier Monate verl\u00e4ngert werden. Ein Gesuch wird bewilligt, sofern nicht offensichtlich keine Aussicht auf Sanierung oder Best\u00e4tigung eines Nachlassvertrages besteht. Das Nachlassgericht hat die provisorische Stundung unverz\u00fcglich nach Eingang des Gesuches zu behandeln und trifft von Amtes wegen weitere zur Erhaltung des schuldnerischen Verm\u00f6gens notwendige Massnahmen (Art. 293a Abs. 1 SchKG).<\/p>\n<p>Nach Art. 293b SchKG setzt das Nachlassgericht einen oder mehrere Sachwalter zur n\u00e4heren Pr\u00fcfung der Aussicht auf Sanierung oder Best\u00e4tigung des Nachlassvertrages ein. In begr\u00fcndeten F\u00e4llen kann jedoch von der Einsetzung eines Sachwalters abgesehen werden.<\/p>\n<p>Haben Sie weitere Fragen?
