LP"},"content":{"rendered":"\r\n<p>Wird einem Gl\u00e4ubiger in einer Betreibung gegen einen konkursf\u00e4higen Schuldner die provisorische Rechts\u00f6ffnung gew\u00e4hrt, besteht oftmals die Gefahr, dass Letzterer Verm\u00f6genswerte unrechtm\u00e4ssig beiseiteschafft, um diese dem Zugriff des Gl\u00e4ubigers zu entziehen.<\/p>\r\n\r\n\r\n\r\n<p>Damit dieser Gefahr entgegengewirkt werden kann, bietet das Gesetz in Art. 162 ff. SchKG dem Gl\u00e4ubiger die M\u00f6glichkeit, die Aufnahme eines Verzeichnisses aller Verm\u00f6gensbestandteile des Schuldners (G\u00fcterverzeichnis) zu verlangen. Hierf\u00fcr erforderlich ist, dass der Gl\u00e4ubiger beim f\u00fcr die Konkurser\u00f6ffnung zust\u00e4ndigen Gericht ein entsprechendes Gesuch stellt und dabei ein Sicherungsbed\u00fcrfnis glaubhaft macht. Ein solches ist zu bejahen, wenn Anzeichen daf\u00fcr bestehen, dass der Schuldner Verm\u00f6gensbestandteile beiseiteschafft, vermindert oder verschleudert. Das Sicherungsbed\u00fcrfnis ist gem\u00e4ss Gerichtspraxis auch dann zu bejahen, wenn das allgemeine Gesch\u00e4ftsgebaren des Schuldners und sein Verhalten gegen\u00fcber dem Gl\u00e4ubiger die Bef\u00fcrchtung nahelegen, dass er sich seinen Zahlungsverpflichtungen zu entziehen versucht.<\/p>\r\n\r\n\r\n\r\n<p>Ist die Aufnahme des G\u00fcterverzeichnisses gerichtlich bewilligt worden, so ist der Schuldner bei Straffolge verpflichtet, daf\u00fcr zu sorgen, dass die aufgezeichneten Verm\u00f6gensst\u00fccke erhalten bleiben oder durch gleichwertige ersetzt werden.<\/p>\r\n\r\n\r\n\r\n<p>Obwohl in der Praxis selten angewendet, stellt die M\u00f6glichkeit der Aufnahme eines G\u00fcterverzeichnis somit ein durchaus griffiges Sicherungsmittel dar: Denn das G\u00fcterverzeichnis umfasst in jedem Fall s\u00e4mtliche Verm\u00f6gensbestandteile des konkursf\u00e4higen Schuldners, selbst wenn die in Betreibung gesetzte Forderung lediglich einen Bruchteil davon ausmacht.<\/p>\r\n\r\n\r\n\r\n<p>Haben Sie weitere Fragen?
