November 2010 nahmen Schweizervolk und St\u00e4nde die Volksinitiative \u00abF\u00fcr die Ausschaffung krimineller Ausl\u00e4nder (Ausschaffungsinitiative)\u00bb an.<\/p>\r\n\r\n\r\n\r\n<p>Die Volksinitiative sah in ihrer urspr\u00fcnglichen Fassung vor, dass Ausl\u00e4nder, welche in der Schweiz hinsichtlich bestimmter Straftatbest\u00e4nde rechtskr\u00e4ftig verurteilt werden, zwingend f\u00fcr eine Zeitspanne von 5 \u2013 15 Jahren des Landes verwiesen werden.<\/p>\r\n\r\n\r\n\r\n<p>Die vom Parlament gest\u00fctzt darauf beschlossene Umsetzung der erw\u00e4hnten Volksinitiative sah &#8211; im Sinne einer ersten \u00abAufweichung\u00bb des urspr\u00fcnglichen Verfassungstextes vor &#8211; dass von einer Ausschaffung krimineller Ausl\u00e4nder ausnahmsweise abgesehen werden k\u00f6nne, wenn diese f\u00fcr den kriminellen Ausl\u00e4nder einen sog. \u00abschweren pers\u00f6nlichen H\u00e4rtefall bewirken w\u00fcrde\u00bb. Dabei sei, so die vom Parlament beschlossene Umsetzung weiter, \u00abder besonderen Situation von Ausl\u00e4ndern Rechnung zu tragen, die in der Schweiz geboren oder aufgewachsen sind\u00bb; d.h. den sog. \u00abSecondos\u00bb. Hierzu hat sich in der juristischen Literatur der Begriff des \u00abH\u00e4rtefalls\u00bb eingeb\u00fcrgert.<\/p>\r\n\r\n\r\n\r\n<p>Die vom Parlament beschlossene Umsetzung sah \u00fcberdies vor, dass die Landesverweisung auf der Stufe des Vollzugs aufgeschoben werden k\u00f6nne, wenn der \u00abBetroffene ein von der Schweiz anerkannter Fl\u00fcchtling\u00bb sei \u00abund durch die Landesverweisung sein Leben oder seine Freiheit [\u2026] gef\u00e4hrdet w\u00e4re\u00bb.<\/p>\r\n\r\n\r\n\r\n<p>Das Obergericht des Kantons Zug hatte sich neuerdings mit einem Fall zu besch\u00e4ftigen, in welchem ein Ausl\u00e4nder erstinstanzlich einer versuchten schweren K\u00f6rperverletzung schuldig gesprochen wurde. Der erw\u00e4hnte Straft\u00e4ter wurde im Alter von 17 Jahren als anerkannter Fl\u00fcchtling in der Schweiz aufgenommen.<\/p>\r\n\r\n\r\n\r\n<p>Das Obergericht des Kantons Zug erwog dabei, dass seine Fl\u00fcchtlingseigenschaft nicht erst auf der Stufe des Vollzugs der Landesverweisung, sondern bereits auf der Ebene deren Anordnung gepr\u00fcft werden m\u00fcsse. Gest\u00fctzt auf diese Erw\u00e4gung kam das Obergericht zum Schluss, dass der betroffene Ausl\u00e4nder nicht des Landes verwiesen werden d\u00fcrfe. Dies, obwohl er auch durch das Obergericht einer versuchten schweren K\u00f6rperverletzung schuldig gesprochen wurde.<\/p>\r\n\r\n\r\n\r\n<p>Diese Argumentation des Obergerichts f\u00fchrt einerseits dazu, dass die urspr\u00fcngliche Fassung der Initiative \u00abF\u00fcr die Ausschaffung krimineller Ausl\u00e4nder\u00bb ein weiteres Mal aufgeweicht wird. Die Literatur hat hierzu den Begriff des sog. \u00abunechten H\u00e4rtefalls\u00bb ins Leben gerufen. Andererseits muss nun die Frage gestellt werden, ob diese Rechtsprechung k\u00fcnftig dazu f\u00fchren wird, dass die schweizerischen Strafgerichte Kompetenzen \u00fcbernehmen, die grunds\u00e4tzlich den Migrationsbeh\u00f6rden zustehen, und ob sie \u00fcberhaupt dazu berechtigt sind.<\/p>\r\n\r\n\r\n\r\n<p>Haben Sie weitere Fragen?
